These conditions are effective as of 14/11/2023. These terms apply to purchases of products made by buyers or customers. This website is intended for the sale of products within Spain.

1. Introduction

The terms and conditions of sale described below (hereinafter, the General Conditions) govern exclusively the contractual relationship between any user of the website https://www.ohfx.us (hereinafter referred to as the “User”, “You”, or “Customer”) and the seller, OhFX Entertainment, SL, with Tax ID (NIF) B64770381 and registered address at C/ Indústria, 4 08592 Sant Martí de Centelles (Barcelona), owner of the website https://www.ohfx.us.

These General Conditions of Sale are the only conditions applicable and replace any other general conditions, except in the case of prior, express, and written cancellation. OhFX Entertainment, SL may occasionally modify the clauses of its General Conditions, and therefore it is advisable to review them on each visit to this website. Such modifications shall apply from the date of their publication on the Internet (from the date indicated above). Each purchase made through the Website shall be governed by the General Conditions applicable on the date the order is placed. We consider that once you place an order and accept our General Conditions of Sale without reservation, you undertake to comply with these General Conditions as well as the rules of use contained therein.

The seller provides information regarding the essential characteristics of the products through technical descriptions and photographs illustrating the products. All such information is provided within the limits of available technology and in accordance with the highest market standards.

4. Prices

The sale prices displayed are shown in euros. VAT is NOT included in the prices.

Shipping costs are the responsibility of the User and will be added to the total amount of the selected products. These costs will be communicated before confirming the order and completing the purchasing process.

The seller reserves the right to modify prices at any time. However, it undertakes to apply the prices indicated on this website at the time the order is placed.

Furthermore, please note that if an incorrect and/or manifestly unreasonable price appears, regardless of the reason (computer bug, manual error, technical error, etc.), the order will be cancelled even if it has initially been validated.

5. Availability

Please note that orders will be shipped subject to available stock.

If any item included in the order is out of stock, we undertake to send you an email as soon as possible informing you of the expected delivery time for your order.

If you are not interested in waiting, you may request cancellation of the order and reimbursement of any amounts already paid. Such reimbursement will be made within a maximum period of seven (7) days from receipt of your email requesting the refund.

6. Shipping Method and Delivery Times

Purchased products will be shipped to the Customer within a maximum period of three (3) business days from receipt of payment.

The seller makes every effort to comply with the stated delivery times; however, it shall not be liable for any consequences resulting from shipping delays or loss of parcels caused by parties external to the transport contract, by the Customer, or by unforeseeable circumstances or force majeure events beyond reasonable control.

If you do not receive a parcel within the indicated period and the seller can certify that it was dispatched, an investigation will be initiated with the carrier. Such investigation may take several days (approximately fourteen (14) business days). During this period, no replacement shipment or refund may be issued.

We recommend that upon receipt of your order you verify that everything is complete and in perfect condition. If the packaging is not in perfect condition, please record any anomalies on the carrier’s delivery note.

7. Payment Methods

If our insurance company or security department suspects any anomaly or fraudulent activity, we reserve the right to cancel the transaction for security reasons.

The seller offers the following payment methods: credit/debit card and Bizum.

A) Credit/Debit Card Payment

Online payments by credit or debit card are processed through the “Secure Socket Layer” (SSL) security system, which encrypts your banking information when transmitted over the Internet.

B) Bizum Payment

Payments via Bizum are processed through our POS payment system with the highest level of security, in the same way as credit card payments.

8. Right of Withdrawal. Returns and Refunds

The User has seven (7) business days to return a product with which they are not satisfied.

Within this period, the product may be returned (shipping costs shall be borne by the User), indicating the order reference number.

We recommend that products be carefully protected before shipment, as the User shall be responsible for any damage suffered during transport. Therefore, we suggest returning goods via registered mail or courier service and insuring them for the value of the product. This insurance may prove useful in the event of loss or damage by the carrier.

When a User returns a product exercising their right of withdrawal, only products returned in their original packaging, in new and complete condition, will be accepted. Products returned incomplete, damaged, or deteriorated by the Customer will not be accepted. Products will only be accepted if their use has been consistent with their nature and purpose.

Refunds

If the returned product complies with all the previously described requirements, the seller will refund the amount paid for the order, excluding shipping costs, by bank transfer to the account number provided by the User.

9. Disputes and Liability

The seller shall not be liable for any failure to perform these conditions in cases of force majeure, fault of the Customer, or unforeseeable events caused by a third party external to the contract.

Likewise, the seller shall not be liable for any consequences resulting from improper use of the products sold.

For the resolution of any disputes, the parties expressly submit to the Courts and Tribunals of Vic (Barcelona).
